By accessing or using the VersaLyze platform, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
VersaLyze provides a platform for YouTube creators to analyze their channel performance, connect with brands for partnerships, and manage copyright issues including striking stolen content and countering false strikes. The specific features and services available to you may depend on your account type and subscription level.
To access certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Distribute harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to any part of the Services
- Interfere with the operation of the Services
- Engage in any fraudulent or deceptive practices
Misuse of our information or services in copyright strikes can result in serious legal consequences, including but not limited to:
- Perjury charges for filing false DMCA claims, which can result in fines up to $500,000 and imprisonment for up to 5 years
- Civil liability for damages caused to content creators, including lost revenue and legal fees
- Defamation claims for making false statements that damage a creator's reputation
- Tortious interference claims for wrongfully interfering with business relationships
- Abuse of process claims for using legal procedures for improper purposes
By using our services, you agree to only submit truthful and accurate information when filing copyright strikes or countering false strikes. VersaLyze reserves the right to terminate your account and report misuse to relevant authorities if we have reason to believe you are misusing our services for fraudulent copyright claims.
VersaLyze reserves the right to suspend or terminate your account at any time for any reason, including but not limited to:
- Violation of these Terms of Service
- Misuse of copyright strike information or services
- Providing false or misleading information
- Engaging in abusive behavior toward other users or our staff
- Using our services for illegal purposes
- Non-payment of fees or chargebacks
- Inactivity for an extended period
Upon termination, your right to use the Services will immediately cease. We may, but are not obligated to, delete your account data following termination. We are not liable to you or any third party for the termination of your account or access to the Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERSALYZE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Travis County, Texas.
